Most business owners have some key employees that require some sophisticated incentive plans to keep them happy. Since congress issues Section 409A in October 2004 the implementation of these plans has gotten more difficult in order to stop perceived abuses. We go over the types of plans that are subject to these new rules and the requirements in order to pass muster with the IRS. There are some serious consequences to not meeting these requirements that we go over as well.
